1. Agreement to terms

By creating an account or using Promoly (promo.ly and mailer.promo.ly), you agree to these terms. If you're using Promoly on behalf of a company, you confirm you have authority to bind that company to these terms.

Promoly is operated by Promo.ly LTD, a company registered in England and Wales (company number 09153668).

2. The service

Promoly is an email marketing platform for music promotion. You can create and send promo campaigns, collect feedback, track engagement, create smartlinks, and manage contact lists. We may add, change, or remove features at any time.

3. Your account

You're responsible for keeping your login credentials secure. Don't share your password. If you suspect unauthorised access, contact us immediately at support@promo.ly.

You must provide accurate information when creating your account. One person or company per account, unless you're on a plan that supports multiple users.

4. Acceptable use

You agree not to use Promoly to:

  • Send unsolicited bulk email (spam)
  • Upload content you don't have rights to distribute
  • Upload or distribute illegal, harmful, or offensive material
  • Attempt to access other users' accounts or data
  • Interfere with or disrupt the service
  • Use purchased or scraped email lists
  • Resell or sublicense access to Promoly

We reserve the right to suspend or terminate accounts that violate these rules. Repeated bounces or spam complaints will trigger automatic restrictions on your account.

5. Your content

You own the content you upload to Promoly. By uploading, you grant us a limited licence to host, process, and distribute that content as needed to run the service (for example, sending it to your campaign recipients).

You're responsible for ensuring you have the rights to distribute any content you upload. This includes music, artwork, and contact lists. If someone claims your content infringes their rights, you're responsible for resolving that claim.

6. Payments and billing

Paid plans are billed monthly or annually in advance. Prices are listed in GBP. All payments are processed securely through Stripe.

Your subscription renews automatically unless you cancel before the renewal date. You can cancel anytime from your account settings. When you cancel, you'll keep access until the end of your current billing period. We don't offer partial refunds for unused time.

We may change pricing with 30 days' notice. Price changes won't affect your current billing period.

7. Free trial

New accounts get a 7-day free trial with 150 sends. No credit card is required. At the end of the trial, you'll need to choose a paid plan to continue using Promoly. Your data stays safe if you don't subscribe immediately.

8. Service availability

We aim for high uptime but we don't guarantee 100% availability. Planned maintenance will be communicated in advance when possible. We're not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.

9. Limitation of liability

To the maximum extent permitted by law, Promoly's total liability to you for any claims arising from your use of the service is limited to the amount you've paid us in the 12 months before the claim.

We're not liable for indirect, incidental, or consequential damages, including lost revenue, lost data, or business interruption. The service is provided "as is" without warranties of any kind, express or implied.

10. Termination

You can close your account at any time from your account settings or by emailing support@promo.ly.

We may suspend or terminate your account if you breach these terms, don't pay your subscription, or if we're required to by law. We'll give reasonable notice when possible.

On termination, your data will be deleted within 90 days, in line with our privacy policy.

11. Indemnification

You agree to indemnify and hold Promo.ly LTD harmless from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to these terms

We may update these terms. If we make significant changes, we'll let you know by email or through the app at least 30 days in advance. Continued use of Promoly after changes take effect means you accept the new terms.
